RightTutors Usage Policy
Preamble :
This e-learning platform, hereinafter referred
to as "RighTutors” or "website”, is operated in Algeria according to the
regulations in force.
The terms "we”, "our”, refer to RighTutors.
The term "Tutor” refers to any operator of
this platform who operates as an
independent (teacher, trainer, coach, etc.).
The terms "you”, "learner” and "customer”
refer to any user of RighTutors who requires tutoring services. This may be a
learner, the parent of a student, a business or any other person wishing to use
the services of a tutor via the RIGHTUTORS platform.
Article 1: object
These Terms of Use (hereinafter - the "Terms”)
describe the general conditions applicable to your access and use of the
Website. The RighTutors website is www.rightutors.com (the
"Website”) and is an online platform intended for use by learners (and/or their
parents) and tutors in connection with the Services.
Use of the RighTutors Services (as defined
above) is subject to these Terms of Use (the "Terms”) and any other rules or
policies posted on the Website that apply to specific activities to which you
participate.
You agree that by using the Services and
providing respective consent, you agree to enter into a legally binding
contract with RighTutors and indicate your unconditional acceptance of these
Terms, on your own behalf and, if you are a Parent or Company, to the name of
the Learner represented by you who uses our Services.
You enter into these Terms with RightTutors.
(Referred to as "RighTutors”, "we” and "us”), a company registered and
organized under the laws of Algeria. These Terms, together with the Refund and
Payment Policy, Privacy Policy and Cookie Policy, are legally binding
agreements governing the relationship between RighTutors and any user or
visitor to the Website and Services.
As a user or visitor to our Services, the
collection, use and sharing of your personal data is subject to the RighTutors
Privacy Policy, Cookie Policy, Privacy Policy and updates respective. For more
information on when, where and why we collect personal data, how we use it, the
conditions under which we may disclose it to others, your rights regarding your
personal data, please refer to our Privacy Policy confidentiality.
You are responsible for your use of the
Services and any use of the Services made using your account. Our goal is to
create a positive, useful and safe user experience. To promote this goal, we
prohibit certain types of behavior that could be harmful to other users or to
us. When using the Services, you must comply with our Community Guidelines.
Article 1: Registration for the service
1.1
Conditions of registration for the Platform
Certain features of the Platform require
registration and the creation of an account. Before registering, you must agree
to these Terms and the Privacy Policy.
You must be over 16 years old and not subject
to a legal protection measure for adults to accept the general conditions of
use. The consent of minors under 16 must be given by the holder of parental
authority.
The Platform does not provide for the
registration or collection of information relating to any person aged 15 or
under.
1.2
Account creation
To create an account, you must:
Manually fill in the mandatory fields of the
registration form on the Platform with complete and accurate information.
Submit to RighTutors certain personal
information, such as your first and last name and email address.
Keep your password confidential and do not
share it with anyone. If your password is lost or disclosed, you must notify
RighTutors immediately.
Use your account personally and do not
authorize others to use it. You may not assign or transfer your account to any
other person or entity.
1.3
Account deletion
You can delete your account at any time by
going to your account settings, selecting the "Delete my account"
option and confirming the deletion. Deleting the account will result in the
permanent loss of all data associated with it.
Article 2. Information provided by you
Each person guarantees to Rightutors that the
information they provide regarding their identity and contact details as part
of the Service is true, accurate, complete and up to date. You are solely
responsible for the sincerity and accuracy of this information. You agree to
regularly update all information in order to maintain its accuracy.
Rightutors cannot under any circumstances be
held responsible for any errors, omissions or inaccuracies that may be noted in
the information that you have provided to us, nor for any harm that may result
from this for other Users or third parties.
You are responsible for all activity that
occurs on your account, and you agree to maintain the security and secrecy of
your username and password at all times. You can only have one account.
Article 3: Reservation and scheduling of
courses
Make sure you choose the correct time zone so
that your class times and your teacher's calendar match your local time.
To book a trial lesson, visit the "Find a
teacher” page. After booking the first lesson with a teacher, you can schedule
more lessons, reschedule them and cancel them in the "My Classes” page.
To book a course on RightTutors, the procedure
to follow is as follows:

Creation of a
personal customer account (Article 1.2). This step is mandatory for booking a
course.

From your
dashboard, go to the "Find a teacher” page.
·
Choose your
teacher and click on the "Book Now” button then follow the steps by choosing
the number of hours to book as well as the dates directly on the Tutor's
availability calendar. If you do not have enough prepaid hours to schedule a
course, you can always purchase hours through one of the payment channels
authorized on the platform (See Article 4.2)

Receipt of a
confirmation email.
·
It is
possible to book a free 30-minute session with each of the Tutors to make your
choice.
·
The customer
can book 24/7 on RighTutors, except in the event of unavailability of the
website for technical reasons.
·
It will be
possible if the customer wishes to be guided in creating their account to place
an order by telephone, message or e-mail, or to ask us to place the order.
Any course reservation on RightTutors commits
the client to be available on the day and times of the agreed course(s).
If you are unable to attend the course due to
absence, the course will be automatically canceled and cannot be rescheduled.
The Learner must justify the latter in order to claim reimbursement for the
missed session.
Article 4: Price and payment terms
4.1
Course prices
Prices for sessions on RightTutors are set by
each Tutor. They are denominated in Algerian Dinar (DA), calculated including
all taxes (TTC).
Tutors grant themselves the right to modify
and update their rates at any time.
4.2
Payment terms
Payment for a course can be made by all the
payment methods offered on the RighTutors platform, namely:

Bank transfer
·
Online
payment by Edahabia or CIB
Article 5: Cancellation of sessions and
reimbursement
Cancellation and reimbursement of sessions is
made according to the following cases:
5.1
The one to one session:
Cancellation by learner: The session for one
to one classes can be canceled 6 hours before the scheduled start time on
behalf of the learner, in which case the funds will be returned to the
learner's balance. In the event that the learner fails to meet the deadline,
the full amount of the scheduled session will be invoiced to the learner,
unless the TUTOR agrees not to invoice it.
Cancellation by the TUTOR: The session for one
to one classes can be canceled 6 hours before the scheduled start time on
behalf of the TUTOR.
5.2
The
group session:
Cancellation by learner: Group classes can be canceled up to 24 hours before the scheduled start
time. In the event that the learner fails to meet the deadline, the full amount
of the scheduled session will be invoiced to the learner, unless the TUTOR
agrees not to invoice it.
Cancellation by TUTOR: Group lessons may be canceled up to 24 hours before the scheduled start
time on behalf of the TUTOR.
5.3
The
training session:
Cancellation by the learner: Training courses can be canceled up to 24 hours before the scheduled
start. In the event that the learner fails to meet the deadline, the full
amount of the scheduled session will be invoiced to the learner, unless the
TUTOR agrees not to invoice it.
Cancellation by TUTOR: Training courses can be canceled up to 24 hours before the scheduled
start time on behalf of the TUTOR.
If there are extenuating circumstances that
caused the learner to miss the one to one class session/group course or
training, a refund can be made, subject to acceptance by the tutor.
In the case of a technical problem on the
RighTutors platform which was the cause of the cancellation of a course,
RighTutors undertakes to reimburse the canceled session(s) in full.
Article 6: Force majeure
Linstashop cannot be held liable if the
non-execution or delay in the execution of one of its obligations described in
these general conditions of sale results from a case of force majeure. As such,
force majeure means any external, unpredictable and insurmountable event.
Article 7: Customer rights and protection
of private data
Any customer of the marketplace has the right
to communicate with customer and sales services for any type of complaint or
request for information.

The Linstashop teams can be reached during
working hours and days, from Sunday to Thursday, from 9 a.m. to 6 p.m.
As part of its activity, Linstashop reserves
the right to collect nominative information and personal data concerning its
customers. This data is used for the purpose of managing orders, improving
services and marketing operations.
Personal data relating to orders and necessary
for their delivery may be transmitted to Linstashop partners, in particular
delivery companies. This information and data is also kept for security
purposes, in order to comply with legal and regulatory obligations.
Sellers using the marketplace are directly
responsible to buyers for any misuse of their personal data. Linstashop assumes
no responsibility towards buyers in this case.
Article 8: Applicable law
These General Conditions of Use are subject to
current Algerian law.
Article 9: Divisibility
If any provision of these terms and conditions
is found by a court or other competent authority to be unlawful and/or
unenforceable, the remaining provisions will remain in force.
If any unlawful and/or unenforceable provision
of these terms and conditions would become legal or enforceable if part of it
were deleted, that part will be deemed to be deleted, and the remainder of the
provision will continue in effect.
Article 10 : Competent Court
Any dispute relating to the interpretation and
execution of these general conditions of sale is subject to Algerian law.
Failing an amicable resolution, the dispute
will be brought before the competent Commercial Court of Algiers.
